1. About FlexStaff

FlexStaff Ltd ("FlexStaff") operates an online platform that connects businesses ("Hirers") with temporary workers ("Workers"). By creating an account you agree to these Terms of Service in full.

2. Eligibility

To use FlexStaff you must be at least 18 years old and have the legal right to work in the United Kingdom. Businesses must be legally registered to operate in the UK.

3. Worker obligations

Workers must:
  • Provide accurate information about their identity, right to work, skills, and experience
  • Arrive on time for every confirmed shift
  • Submit accurate hours worked within 72 hours of a shift ending
  • Behave professionally and follow the Hirer's reasonable instructions
  • Notify FlexStaff immediately if they cannot attend a confirmed shift
Repeated no-shows or policy violations may result in suspension or removal from the platform.

4. Business obligations

Businesses must:
  • Provide accurate job descriptions, locations, and working conditions
  • Maintain a valid payment method on file at all times
  • Approve or dispute worker hours within 72 hours of submission
  • Provide a safe working environment compliant with UK Health & Safety law
  • Not directly contact, hire, or engage workers outside the FlexStaff platform for 12 months following an introduction

5. Payments and fees

FlexStaff charges businesses a platform fee (currently 15%) on top of worker wages, plus applicable employer statutory costs (National Insurance, holiday pay, pension, apprenticeship levy) and 20% VAT. The full cost breakdown is shown before posting a job.

Businesses are charged automatically when they approve worker hours. Invoices are generated and emailed immediately. FlexStaff pays workers directly via BACS transfer.

6. No-shows and cancellations

Workers who fail to attend a confirmed shift without notice will receive a strike. Three strikes result in account suspension. Businesses may report no-shows through the platform within 24 hours of the shift end time.

Businesses that cancel a shift with less than 24 hours' notice may be charged a cancellation fee equivalent to 2 hours' wages per booked worker.

7. Disputes

Disputes about worked hours must be raised through the FlexStaff platform within 72 hours of hour submission. FlexStaff's decision on disputed hours is final. Unresolved disputes may be escalated to our support team at support@flexstaff.co.uk.

8. Prohibited conduct

You must not:
  • Create false accounts or impersonate others
  • Submit fraudulent hours or claims
  • Harass, threaten, or discriminate against other users
  • Attempt to circumvent platform fees by direct engagement
  • Use the platform for any unlawful purpose

9. Limitation of liability

FlexStaff acts as an employment business introducing workers to hirers. We are not liable for losses arising from worker performance, business cancellations, or circumstances beyond our reasonable control. Our total liability is limited to fees paid in the 3 months prior to any claim.

10. Changes to these terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
